JUSTICE SANDEEP KUMAR ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Revilganj P.S. Case No. 416 of 2022, registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code, 1860 read with sections 25 (1-b)a, 26, 35 of Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 12.12.2022. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed.

No.24269 of 2023(2) dt.19-05-2023 2/2 Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1, Saran at Chhapra in connection with Rivilganj P.S. Case No. 416/2022.

This is also subject to the conditions that the petitioner shall mark his presence in Rivilganj Police Station, District- Saran at Chhapra on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
