1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Compliant Case no. 47 of 2021 registered under sections 323, 325, 504, 406, 497 and 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

3. As per the prosecution case, the complainant states that the petitioner who happens to be her husband as also the other accused persons abused, assaulted and tortured her for non-fulfillment of the demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason of his being the husband of the complainant. It is submitted that the petitioner was enlarged on anticipatory bail by this Court, however, as a result of his inability to pay the maintenance amount that his bail bond was cancelled and he was taken into custody on 18.9.2025. He has remained in custody from more than 6 months and undertakes to cooperate in the case/trial.

5. The application is opposed by learned APP for the State and learned counsel for the opposite party no. 2. Learned counsel for the opposite party no. 2 submits that the petitioner has not complied with the conditions laid by Court while granting anticipatory bail to him of paying maintenance of Rs. 5000/.

6. On a query by the Court, learned counsel for the opposite party no.2 submits that Maintenance case no. 52 of 2023 has been filed by the complainant and is pending in the Court of the learned Principal Judge, Family Court, Begusarai.

7. It is directed that in case the petitioner has not already appeared in the maintenance case, he will appear there within a period of four weeks.

Having learned counsel for the parties and taking into consideration the facts and circumstances of the case and especially the petitioner having remained in custody for more than 6 months since 18.9.2025, the Court directs the petitioner to be enlarged on bail in connection with Compliant Case no. 47 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai.
