JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2019 This application, for grant of anticipatory bail, arises out of Jamalpur P.S. Case No. 43 of 2012, disclosing offences under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that some unknown criminals committed murder of the son of the informant, while he was coming home from his saloon and informant suspected the hands of petitioner and others in the offence.
Submission of learned counsel for the petitioner is that he is not named in the F.I.R. he has been made accused on the basis of restatement of the informant and that too only on the basis of suspicion and except that there is nothing against the petitioner. Further submission is that co-accused persons having
Patna High Court Cr.Misc. No.78483 of 2018(2) dt.09-01-2019 2/2 similar allegation have already been granted the privilege of anticipatory bail vide order dated 18.06.2018 passed in Cr. Misc. No. 21822 of 2018 and vide order dated 3.10.2018 passed in Cr. Misc. No. 60910 of 2018.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Jamalpur P.S.
