Petitioner seeks regular bail in connection with Case No. C2-114/2022 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise Act 2016. Three accused persons who were coming from Nepal were intercepted by the SSB Officials, however, two persons succeeded in fleeing away while one person (petitioner) was arrested with 150 litres of illicit liquor kept on the bicycle. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he is a student aged about 19 years. He further submits that the bicycle and the illicit liquor do not belong to petitioner and he was not aware that the two persons who fled away from place of occurrence,
Patna High Court CR. MISC. No.24346 of 2022(2) dt.25-05-2022 2/2 were carrying illicit liquor. The petitioner is in custody since 20.03.2022.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is a student and he is in custody since 20.03.2022, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court No.II, Sitamarhi in connection with Case No. C2114/2022.
