====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-08-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Goradih P.S. Case No. 26 of 2024 for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

3. The allegation is of committing murder of the daughter of the informant due to non-fulfillment of demand of dowry.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is devar of the deceased and he is living separately from the affairs of the deceased and her husband. Petitioner is in custody since 06.06.2024 having clean antecedent. Other co-accused who are father-in-law and mother-in-law of the deceased have already been granted bail by

5. Learned A.P.P. for the State has opposed the prayer for grant of bail to the petitioner.

6. Considering the aforementioned facts and circumstances of the case and the fact that father-in-law and mother-in-law of the deceased have already been granted bail by a co-ordinate Bench, petitioner who is devar and is in custody since 06.06.2024, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-XIX, Bhagalpur / concerned court in connection with Goradih P.S. Case No. 26 of 2024, subject to the following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature

7. The bail application stands disposed of.
