JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409, 420, 466, 467, 468, 472 and 120B/34 of the Indian Penal Code. The prosecution case is that the petitioner being the Head Clerk posted in the office of Additional Primary Health Centre, Sahjahapur transferred the GPF amount of employment to the tune of `56 lakhs in the bank account of his mother. It is submitted by learned counsel for the petitioner that the petitioner could not have transferred such huge amount without order of superior officer. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the nature of accusation, this Court is not
Patna High Court Cr.Misc. No.56670 of 2015 (2) dt.15-12-2015 2/2 inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected in connection with Daniyawan P.S. Case No. 67 of 2015 pending in the court of learned JM, 1st Class, Patna City, Patna.
