JUSTICE SHIVAJI PANDEY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and learned counsel for the State.

In this case, the petitioners are seeking anticipatory bail in connection with Hathauri P.S. Case No.48 of 2013, registered for the offence punishable under Sections 147, 148, 149, 323, 324, 325, 307, 427 and 504 of the Indian Penal Code. Allegation has been made against the petitioners that they have assaulted the informant and other family members. Learned counsel for the petitioners submits that there is land dispute between the parties and no specific allegation has been made against the petitioners.

Patna High Court Cr.Misc. No.15871 of 2017 (3) dt.19-08-2017 2/2 Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. If the petitioners surrender before the Court below within three weeks from today and pray for bail, the court below will pass the order in accordance with law without being influenced by the order of this Court.
