The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 20, 22 and 23 of the N.D.P.S. Act.

The prosecution case is that 20 grams of ganja were recovered from the shop of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery is of small quantity. A statement has been made in paragraph no.3 of the petition that the petitioner is also accused in two other cases, in which he is on bail.

Learned APP submits that recovery has been made from the shop of the petitioner.

Considering the quantity of recovery, it is a case for

Patna High Court CR. MISC. No.21723 of 2019(2) dt.09-04-2019 2/2 consideration of regular bail by the learned Court below if the petitioner surrenders within a period of six weeks in connection with NDPS Case No. 04 of 2019, arising out of Dhoraiya P.S. Case No. 33 of 2019, pending in the Court of learned Sessions Judge, Banka.
