The application has been filed for recall of the order dated 21.06.2012 passed by this Court in Company Petition No.

4 of 2009 by which the company petition was dismissed after noting the circumstances that it cannot proceed any further in view of the inability of the petitioner to bring upto date statement of accounts on the record, despite repeated adjournments having been granted for a period of nearly one year and nine months and the last accounts being of the financial year ending on 31.3.

Patna High Court MJC No.2702 of 2015 (2) dt.16-03-2016 2/2 from the Corporation's fund.

The recall is now sought on the ground that subsequently the audited statements of accounts have been prepared.

In view of the reasons assigned in the order of dismissal, I do not find any good ground for recall of the said order.

The application for recall is, accordingly, dismissed.
