The sole petitioner, who is named accused in the F.I.R. i.e. Tekari (Panchanpur O.P.) P.S. Case no.45/2011 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code, has prayed for grant of anticipatory bail mainly on the ground that in identical situation number of accused persons have been granted anticipatory bail. He further submits that there is no accusation against the petitioner.
Besides hearing learned counsel for the parties, I have also perused the materials available on record. On perusal of the F.I.R., it is evident that the petitioner is one of the named
Patna High Court Cr.Misc. No.26455 of 2016 (2) dt.30-06-2016 2/2 accused persons. On examining the record, I do not find any ground to extend the privilege of anticipatory bail. The petition stands dismissed.
It goes without saying that if the petitioner appears before the court below within a period of six weeks from today and makes a prayer for regular bail, learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day.
