The petitioner is apprehending his arrest in connection with Agion P(G) P.S.Case no.68 of 2018 registered for offences punishable under Sections 406, 409 of the Indian Penal Code. Allegation against the petitioner is about defalcation of Rs.2,13,050/- which has been given for construction of work in the primary school and he is said to be the I/C Headmaster. Submission of the learned counsel for the petitioner is that Rs.05 lac had been allotted to the petitioner; out of which he has completed the work of Rs.2,86,950/- and as he has retired he could not deposit the same and now he is ready to deposit Rs.2,13,050/- if some reasonable time is given to him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1213 of 2019(3) dt.07-02-2019 2/2 circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from the date of order along with a bank draft of Rs.1,13,050/- in favour of the District Programme Officer then he will be granted provisional bail for the period of two months in connection with Agion (G) P.S.Case no.68 of 2018 on the condition that rest of the amount shall be paid within a period of two months and once all the amount is paid, his bail bond shall be confirmed, otherwise the learned court below shall pass any other order or orders as he deems fit and proper.
With the aforesaid observation, this application is disposed of.
