====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 02-11-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend arrest in Bagan Gola P.S. Case No. 22 of 2015 dated 26.05.2015 instituted under Sections 147/341/323/504/307 of the Indian Penal Code. The allegation against the petitioners and four others is of assault on the wife, brother and other family members of the informant.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.47614 of 2015 (2) dt.02-11-2015 2/2 allegation of assault is general and omnibus in nature and the reason is petty dispute relating to water having fallen on the wife of one Bablu Yadav. It is further submitted that even the injury report of the brother of the informant shows lacerated wound which has been found to be simple in nature. Learned counsel submits that petitioners, besides being innocent, have no criminal antecedent.
Learned A.P.P. submits that there is allegation of assault against the petitioners.
Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Bagan Gola P.S. Case No. 22 of 2015, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
