JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Dinara P.S. Case No.93 of 2017 registered under Sections 307/34 of the Indian Penal Code as well as Section 27 of the Arms Act. Later on case turned into Section 302 of the Indian Penal Code. Allegation in brief is that a function was organized on the occasion of newly born child of the petitioner and the informant was performing. It is alleged that six accused persons named in the First Information Report including the petitioner opened indiscriminate firing and tried to aim on some pot keeping on the head of the informant when she was dancing and one of the shots hit the lady dancer and a child causing fire arm injury, and the dancer died while undergoing treatment.

No.28813 of 2017 (2) dt.01-07-2017 2 / 2 Learned counsel for the petitioner submits that it is unbelievable story that the father himself will indulge in such activities during a function organized by him. Having considered the nature of offence and death caused to the dancer and firearm injury to the child, it is not a case of anticipatory bail, accordingly, the prayer of anticipatory bail of the petitioner is rejected in connection with Dinara P.S. Case No.93 of 2017, pending in the court of the learned A.C.J.M., Bikramganj, Rohtas.
