JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 Earlier the prayer for bail of the petitioner was rejected vide order dated 05.09.2018 passed in Cr. Misc. No. 44645 of 2018 with a direction that once the charge has been framed he may be released on bail.
Submission of learned counsel for the petitioner is that the investigation is still going on under the P.C. Act and as such the charge has not been framed. Further submission is that other co-accused person having similar allegation has been granted bail by this Court vide order dated 01.11.2018 passed in Cr. Misc. No. 55951 of 2018. The petitioner is in judicial custody since 18.05.2018.

Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.508 of 2019(2) dt.16-01-2019 2/2 circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance 1st, Patna, in connection with Special Case No. 47/2018 arising out of Beur P.S. Case No. 146/2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
