====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 07-09-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354(B), 379, 504, 147, 149 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is alleged to have assaulted the son of the informant on the orders of Nepali Singh by an iron rod causing injury on head.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is next submitted that the parties have filed compromise petition on 15.12.2021 as specifically pleaded at Para-14 of the bail

The learned counsel thus submits that since the case has been compromised between the informant and the accused persons, as such, no useful purpose would be served by sending the petitioner to jail when petitioner is a person with clean antecedent.

Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with S. Kamal P. S. Case No.200 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

However, the trial Court before accepting the bail bonds shall verify whether a compromise has been entered into between the informant and the accused persons or not. In the event, if it is found that no compromise was arrived at between the parties, then the present order of anticipatory bail shall not
