The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
It is alleged that certain irregularities were found in the execution of government schemes. On the direction of Director DRDA an inquiry was made and on the basis of such allegation the present FIR has been lodged against petitioner and others under Sections 409, 420 of the Indian Penal Code. It is submitted that petitioner has been falsely implicated in this case. At the relevant time petitioner was Junior Engineer. As a matter of fact, it is the Secretary and Ward members who are responsible for the execution of schemes, the
Patna High Court CR. MISC. No.24049 of 2023(2) dt.27-06-2023 2/2 only role of petitioner is to take measurement of the work on the direction of senior officials. Moreover, petitioner has retired from his service in the year 2021. Petitioner claims clean antecedents.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara in connection with Barahara P.S. Case No. 670 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
