The petitioner seeks bail in connection with Hajipur Nagar P.S. Case No. 455 of 2018 for the offence under Sections 414, 420, 467, 468, 471/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing has been recovered from the possession of the petitioner. So far confessional statement of the petitioner is concerned, the petitioner has confessed his guilt on the pressure of the police. The petitioner is rotting in custody since 21.07.2018.
Patna High Court Cr.Misc. No.1039 of 2019(2) dt.25-01-2019 2/2 Learned A.P.P. appearing for the State has opposed the prayer for bail and submitted that the petitioner is named in F.I.R. and he has confessed his guilt that he has stolen a four wheeler and kept it in his rented flat. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to this petitioner at this stage. Accordingly, the prayer for bail of this petitioner is rejected.
However, the petitioner may renew his prayer for bail after framing of charge.
