The petitioner apprehends his arrest in Giriak P.S. Case No. 334/2016, registered for the offences punishable under Section 307, 120B of the Indian Penal Code and section 27 of the Arms Act.

The informant alleged that while he was sleeping in his house Rajesh @ Indresh Prasad came along with one person and Rajesh fired from his pistol which hit on his right Panjara. The informant further alleged that the occurrence took place at the instance of his son-in-law Amriteshwar Kumar Agrawal. He earlier killed her elder daughter and he was putting pressure to compromise the case.

Patna High Court Cr.Misc. No.29196 of 2017 (3) dt.19-08-2017 2/2 Learned counsel for the petitioner submits that petitioner was not even present at the place of occurrence. The petitioner was working in Gujarat.

Considering the facts aforesaid and the fact that petitioner was not even present at the place of occurrence, the informant only suspected that at the instance of his son-in-law the occurrence took place, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Nalanda at Biharsharif in connection with Giriak P.S. Case No. 334/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
