The petitioner seeks bail in a case registered under Sections 3⁄4 of Explosive Substance Act and 17 of C.L.A. Act. Prosecution case, in short, is that on 31.05.2014 while the informant along with police personnel was on raid and search duty, they found explosion substance and devices near Pachrukhiya, which was seized. The informant suspected the hands of the Moist named in the F.I.R.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.05.2016. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Altogether 34 persons are named in the F.I.R. including the petitioner. No
Patna High Court CR. MISC. No. 1942 of 2019(7) dt.16-07-2019 2/2 incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has remained in custody for approximately three years.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad-hoc Additional District & Sessions Judge 7th, Aurangabad in connection with Madanpur P.S. case No.87 of 2014.
