JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Kishanpur P.S. Case No.275 of 2018, disclosing offences under Sections 302, 328, 120(B), 34 of the Indian Penal Code.

Prosecution story is that the daughter-in-law of the informant had love affair with the petitioner which was protested by her son (deceased), as such, they kill the son of the informant by administering poison.

Submission of the learned counsel for the petitioner is that as a matter of fact, he was not present in the house at that time and he was on duty. He has falsely been implicated in this case.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is direct allegation against the

Patna High Court CR. MISC. No.21078 of 2019(3) dt.20-06-2019 2/2 petitioner.

Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid, this application is dismissed. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
