Petitioners are apprehending arrest in connection with Hisua P.S. Case No. 33 of 2020 for the offence under section 30(a) of the Bihar Prohibition and Excise Act. In the instant case total 15 liters of country made liquor was seized alongwith utensils used for manufacturing liquor.
Learned counsel for the petitioners submits that petitioners have no criminal antecedent and nothing was recovered from their possession. He further submits that recovery was made from a wheat field.

No.21430 of 2020(2) dt.23-07-2020 2/2 Considering the fact that the petitioners have no criminal antecedent and the recovery was made from the wheat field, the Court is inclined to grant anticipatory bail to the petitioners, let the petitioners, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Nawada, in connection with Hisua P.S. Case No. 33 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that on release the petitioners shall render their service as volunteer in dedicated Covid-19 hospital for a period of one month. They are required to report to the district Nodal Officer who shall utilize the service of the petitioners appropriately.
