JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-08-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Kishanpur P.S. Case No. 43 of 2017 registered under Sections 409 and 420 of the I.P.C. pending in the Court of C.J.M., Supaul.

Submission is that petitioners have falsely been implicated in this case. They have obeyed the direction of the higher officer and handed over the money to the officer concerned during Panchayat election.

Learned A.P.P. appearing on behalf of the State

Patna High Court Cr.Misc. No.28579 of 2017 (3) dt.23-08-2017 2/2 opposed the prayer of the petitioners with submission that there is direct allegation against the petitioners.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioners for anticipatory bail. Accordingly, this application is rejected.
