The petitioner apprehends his arrest in Rajauli P.S. case No. 80 of 2001 for the offences punishable under Section 467, 468, 471, 420, 120B of the Indian Penal Code. The Sub divisional Postal Inspector lodged the case making allegation that on the basis of forged money orders the petitioner and his wife received money. During the course of investigation, it transpired that petitioner also disclosed that he gave address of his cousin, Sanjay Singh.

The learned counsel for the petitioner submits that petitioner did not receive any money order. Wife of the petitioner received the money orders and there is no involvement of the petitioner in the entire case but it appears from perusal of the case

Patna High Court Cr.Misc. No.29508 of 2017 (3) dt.30-10-2017 2/2 diary that it was the petitioner who hatched up conspiracy in sending money orders in different names including the name of his wife, Mangita Devi. Money orders were also received by the wife of the petitioner. The case is of the year 2001 and the petitioner has already been declared absconder.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
