The petitioner seeks bail in a case registered under Sections 385, 387, 307/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief is that while the informant along with one Mantu Yadav was sitting in his shop, three unknown persons riding on motorcycle came there and fired which ensnared in the packet of SARI.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-08-2018. Charge sheet has already been submitted. None is said to have

Patna High Court CR. MISC. No.21548 of 2019(3) dt.08-05-2019 2/2 sustained injuries in course of the occurrence. No offence u/S 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Danapur in connection with Danapur P.S. Case No. 439 of 2018.
