JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-06-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Hawai Adda P.S. Case No. 104 of 2016 for the offences punishable under sections 406, 420, 467, 468, 471 and 34 of the I.P.C.

Allegedly, the petitioner, being Assistant in the District Agriculture Office, in collusion with other co-accused committed irregularities in the distribution of the agricultural tools and on the same chassis number several power tillers have been shown to be purchased.

Submission is of false implication and that for the

Case No. 102 of 2013 was registered against the shop-keepers and the farmers who are beneficiaries and in that case charge sheet has already been submitted and the trial is going on and again for the same offence the petitioner and others have been implicated without any material and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that there was connivance of the petitioner also.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of.
