The petitioner seeks bail in Khagaria (Mufassil) P.S. Case No.736 of 2018 registered under Section 341, 323, 307, 504 and 506/34 of the Indian Penal Code.
Petitioner along with other accused persons are said to have assaulted the informant, his brother and two other family members by means of lathi, danda and sword.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. The petitioner has committed no
Patna High Court Cr.Misc. No.79291 of 2018(2) dt.18-01-2019 2/2 offence. He has no concern with the aforesaid occurrence. He has been falsely implicated in this case. There is a case and counter case between the parties over a land dispute. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is no incised wound on the person of any of the victim. The petitioner is aged about 75 years and has been languishing in custody since 25.10.2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Mufassil) P.S.
