The petitioner seeks bail in Bhagwan Bazar P.S. Case No. 34 of 2020, registered for the offence punishable under Sections 399, 402, 414 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.

On secret information that some miscreants have assembled to commit crime, a raid was conducted and one coaccused Rahul Kumar @ Vicky was arrested who disclosed the name of other co-accused including this petitioner. From possession of Rahul Kumar arms, mobile, bike have been recovered.

It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner and he has been made accused in this case on the

Patna High Court CR. MISC. No.35274 of 2021(2) dt.08-12-2021 2/2 basis of disclosure made by co-accused Rahul Kumar @ Vicky. Arms and ammunition has been recovered from possession of co-accused Rahul. Petitioner has been remanded in this case on 30.09.2020 and since then he is in custody.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 34 of 2020.
