JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Phulparas P.S. Case No. 318 of 2012 registered under Sections 341, 323, 324, 325, 379, 306, 506 and 34 of the Indian Penal Code.

The accusation is that due to land dispute this petitioner has caused injury to the informant through knife at his elbow whereas other accused named in the F.I.R. caused injury through lathi.

Learned counsel appearing on behalf of the petitioner submits that there is specific allegation against the petitioner and other accused persons to cause injury at the elbow of the

No.47344 of 2015 (2) dt.11-02-2016 2/2 informant, but only three injuries were found on the person of the informant, in which one injury is found simple in nature and other two injuries are grievous caused by hard and blunt substance, which is said to be caused by the other accused persons not by this petitioner.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jhanjharpur in connection with Phulparas P.S. Case No. 318 of 2012, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
