JUSTICE RAVI RANJAN ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner, the State and the Vigilance Investigation Bureau.

The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420/467/468/471/120B of the Indian Penal Code.

As per allegation the petitioner has obtained employment on the post of teacher on the basis of forged experience certificate.

However, it is contended on behalf of the petitioner that he never filed any certificate and in fact the selection list prepared by the Selection Committee which has been appended as Annexure 3 clearly demonstrates that selection was on the basis of

Patna High Court Cr.Misc. No.26140 of 2016 (2) dt.30-06-2016 2/2 marks obtained in examination conducted by the Bihar School Examination Board and not on the basis of any experience as experience column has been kept vacant.

Having regard to the aforesaid facts and circumstances of the case, let the petitioner Bishambher Yadav @ Vishambhar Yadav be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Barhara (Khawaspur O.P.) P.S. Case No. 156 of 2016 on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
