The petitioner is apprehending his arrest in connection with Jandaha P.S.Case no.35 of 2018 , registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per FIR is of committing loot of Holland Tractor from the house of the informant apart from ATM card and cheque books. The petitioner is not named in the FIR and later on his name transpired on the confessional statement of the co-accused.

Submission of the learned counsel for the petitioner is that except confessional statement, there is nothing against him and he has no criminal antecedent, however, the learned APP has opposed the prayer for bail stating that he has been named on confessional statement of the father of the petitioner who has

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Prabhat Krishna, ACJM XIth, Vaishali at Hajipur in connection with Jandaha P.S.case No.35 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is allowed.
