The petitioner is in custody in connection with Special Case No. 3441 of 2020, arising out of Kadamkuan P.S. Case No. 186 of 2020, for the offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Sections 120(B) and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner. The liquor was seized from Rajendra Nagar, Road No.10, near Ram Narayan Shashtri Marg. He further submits that the petitioner has got no criminal antecedent and he is in custody since 13.05.2020. Case No. 186 of 2020 with the condition that the petitioner on release will render his service as volunteer for a period of one month in dedicated Covid Hospital.
