JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State.

Petitioner apprehends her arrest in connection with P.S. Case No. 8/2017 under Section 354/34 of the Indian Penal Code and Sections 8, 12 of the POCSO Act.

Allegation in brief is that while the informant was coming after attending coaching classes and when she reached near the house of Sunita Devi, Sunita Devi called her in her house and forced to sit on the palang. In the meantime Dhiraj Kumar Singh came there with bad intention and started to pull her towards him and when she raised alarm Dhiraj Kumar fled away. Learned counsel appearing on behalf of petitioner submits that the petitioner was acquainted with the girl and simply

Patna High Court Cr.Misc. No.14619 of 2017 (3) dt.14-06-2017 2/2 she called her in the house, in the meanwhile Dhiraj came and tried to pull her that there is no any allegation of sexual assault by the petitioner or helping Dhiraj another accused in any manner, moreover she has clean antecedent.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge cum-Spl. Judge, POCSO Act, Muzaffarpur in Saraiya P.S. Case No. 08/2017.
