The petitioner seeks bail in a case registered under Sections 8, 20(b)(ii)(c), 25, 29 of the N.D.P.S. Act and Sections 25(1-b)a/35 of the Arms Act.

Allegation is that two kg ganja and one country made pistol are recovered.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application. It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.03.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. One country made pistol and 2 kgs ganja are alleged to have been recovered from

Patna High Court CR. MISC. No.981 of 2019(4) dt.12-04-2019 2/2 his paultery farm as per the seizure list. The petitioner has got no concern in respect of recovery made from the house of Raj Kumar. There is no compliance of Sections 42 & 50 of N.D.P.S. Act and Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Darbhanga in connection with G.O. case No.04 of 2018 arising out of Baheri P.S. case No.49 of 2018.
