The petitioner seeks bail in connection with Agiaon Bazar P.S. Case No. 121 of 2018 instituted for the offence under Section(s) 366(A) of the Indian Penal Code.

Learned counsel for petitioner has submitted that victim girl has given her statement under Section 164 Cr.P.C. wherein, she has stated that she has voluntarily gone with this petitioner to Goa and she has not been kidnapped. The aforesaid statement has been annexed as Annexure-2 to the bail petition. It is alleged in the written report that daughter of informant, namely, Sonam Kumari aged about 15 years has been taken away by this petitioner for the purpose of marriage. The victim girl has stated in her statement U/s 164 Cr. P.C. that she

Patna High Court CR. MISC. No.23420 of 2019(2) dt.11-04-2019 2/2 wants to live with this petitioner. She has love affairs with this petitioner for last one year and 1⁄2 years. Petitioner is in custody since 25.10.2018 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VIII, Bhojpur, Ara in connection with Agiaon Bazar P.S. Case No. 121 of 2018, G.R .No. 4733 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
