The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 469, 471 and 120(B)/34 of the Indian Penal Code. Prosecution case in brief is that the petitioner who is Principal of Sardar Patel College, Jagdishpur and the aforesaid Management Committee of Sardar Patel College used forged pad and seal of Circle Officer to convey wrong information about nature of land and got the order of affiliation. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not submitted any forged

No.35426 of 2021(5) dt.21-06-2022 2/2 document with any malicious intention to show that aforementioned land is under urban area because the authorities of the College were under impression that the land is under urban area as reported by Circle Officer himself, it is only 500 meters away from the border line of Bodha Tola which is part of Nagar Panchayat Jagdishpur, i.e., Urban area for the purpose of affiliation. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM- Ist, Ara in connection with Jagdishpur P.S. Case No.09 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
