The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 307 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, on 02.09.2022, the marriage ceremony was going on in the house of injured Farzana Khatoon and at the time of Vidai, some unknown person fired in which Farzana Khatoon got gunshot injury on her temporal region and Md. Raj got firearm injury on his chest. It is submitted that petitioner is not named in the FIR. Name of petitioner surfaced on the basis of statement of witnesses recorded by the police during course of investigation. It is further submitted that both the injured persons namely,
Patna High Court CR. MISC. No.23988 of 2023(2) dt.27-06-2023 2/2 Farzana Khatoon and Md. Raj filed a compromise petition stating therein that the petitioner happens to be the close door neighbour of Farzana Khatoon who has played no role in the commission of present offence which annexed as Annexure-2 to this petition. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Begusarai in connection with Phulwaria P.S. Case No. 146 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
