JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It is pointed out on behalf of the petitioner that earlier the petitioner came before this Court for grant of anticipatory bail but his prayer for bail was rejected giving liberty to him to deposit the amount in question with compoundable interest and if petitioner does so, the concerned court shall consider the aforesaid prayer of the petitioner and pass appropriate order on the petition. It is further pointed out by him that petitioner has already deposited the amount in question with compoundable interest and, therefore, petitioner needs some protection so that he could not be sent behind the bar. It is pointed out by him that in
Patna High Court Cr.Misc. No.47280 of 2015 (2) dt.16-12-2015 2/2 similar nature of the case a co-ordinate Bench of this Court vide order dated 40501 of 2015 passed in Cr. Misc. No. 06.11.2015 granted privilege of anticipatory bail to the petitioner. In view of the aforesaid submissions this petition stands disposed of with direction to the petitioner to surrender before the court of Sub -Divisional Judicial Magistrate, Daudnagar, Aurangabad within three weeks from the date of receipt / production of copy of this order and if petitioner does so and makes prayer for grant of regular bail, the concerned court shall consider the aforesaid prayer for regular bail of the petitioner in positive manner if the petitioner has already deposited the amount in question with compoundable interest and shall pass appropriate order on the bail petition of the petitioner on the date of his surrender.
