1. Heard learned counsel for the petitioner and learned counsel appearing on behalf of the respondents.

The present writ application has been filed by the petitioner seeking a direction upon the respondents to make payment of the arrears of salary due for the period from 13.02.2008 to 12.06.2009, on the ground that during the said period the petitioner's husband, who was posted in BIADA, was terminated from service in an illegal and arbitrary manner.

Learned counsel for the petitioner has submitted that the order of termination of the deceased employee was set aside and, thereafter, he was reinstated in service, however, the payment due to him has still not been made. It has further been submitted that reliance is placed upon Annexure-14, being the order passed by this Court in C.W.J.C. No. 10080 of 2011, whereby the employees of BIADA who had approached this Court were granted and extended the relief now sought by the petitioner. It is further submitted on behalf of the petitioner that an L.P.A. No. 594 of 2023/LPA No. 631 of 2023 was filed only after the entire payment had been made by the concerned authorities to the petitioners in C.W.J.C. No. 10080 of 2011.

4. Hence, learned counsel for the petitioner has submitted that the petitioner shall file a representation before the concerned authority, namely respondent no. 4 and the said authority may be directed to consider and decide the representation in the light of the orders passed by this Court.

5. Permission is accorded.

6. Let the representation be filed before the concerned authority within a period of four weeks from today. Upon receipt of the representation, the concerned authority shall consider and dispose of the same by passing a reasoned and

7. At this juncture, learned counsel appearing on behalf of the respondents, have stated that L.P.A. No. 594 of 2023 along with L.P.A. No. 631 of 2023 have been preferred against the order passed in C.W.J.C. No. 10080 of 2011 and are pending final adjudication before this Court. In my opinion, while taking a decision and passing a speaking order, the authorities shall also take into account the orders passed by this Court as well as the aforesaid L.P.As. pending consideration before this Court.

8. The application stand disposed of with the above said observations.
