2. The petitioner has prayed for bail in connection with Mehsi P.S. Case No.212 of 2025 registered for the offence punishable under Sections 127(2), 127(7), 308(3), 308(4), 351(2), 111(2) & 3(5) of the Bharatiya Nyaya Sanhita.
3. The case of the prosecution, in short, is that the petitioner along with others abducted the informant's brother Arjun Prasad and nephew Abhishek Kumar were coming to their house after consulting the mater of land dispute. After that they were confined at the house of Mukesh Pathak where they were assaulted. They were released with threat of dire consequences if the matter is reported to police.
4. Learned counsel appearing on behalf of the petitioner has submitted that the nature of allegation is general
Patna High Court CR. MISC. No.25804 of 2026(2) dt.16-04-2026 2/2 and omnibus. There is land dispute between the parties. It has further been submitted that no injury has been caused to any person in the alleged occurrence. It has further been submitted that similarly situated co-accused Avinash Kumar Giri, Dhiraj Yadav, Vikash Mishra, Bipin Singh have been granted bail by learned Co-ordinate Bench of this Court. The case of this petitioner stands on similar footing. Learned counsel for the petitioner has further submitted that the petitioner is in judicial custody since 09.02.2026.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Judicial Magistrate, First Class, East Champaran, Motihari in connection with Mehsi P.S.
