JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-01-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Biraul P.S. Case No. 210 of 2014 registered under Sections 353, 504 and 186 of the Indian Penal Code.
The accusation is that on 02.07.2014 at about 11.30 am., meeting was organized in between the Block Education Officer and Principals of Middle School, Biraul. In the said meeting, both petitioners started hot exchange of words on some points. In stead of repeated requested by the informant, both did not take care and disturbed the meeting. Further, case of the informant is that earlier warning was also given to both the
Patna High Court Cr.Misc. No.47306 of 2015 (2) dt.27-01-2016 2/2 petitioners about mid day meal and construction of building, due to that reasons, they were annoyed with the informant. Learned counsel appearing on behalf of the petitioners submits that petitioners, being the Head Masters of the Middle School, raised their grievance in the meeting, but the informant, who is the Block Education Officer, was not ready to hear their grievance and only due to undue pressure, the present case has been lodged by him. Moreover, the informant has filed the compromise petition in the trial Court.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Biraul, Darbhanga in connection with Biraul P.S. Case No. 210 of 2014, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
