JUSTICE RAJIV ROY ORAL ORDER 02-02-2023 Heard Mr. Sandeep Kumar Gautam, learned counsel for the petitioner and learned APP for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 89C of 2021 for the offence registered under Sections 498(A), 497, 323, 504 and 379 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. On the earlier occasion, the Co-ordinate Bench had issued notice to the opposite party on 09.11.2022 which has been received by her brother (registered cover notice) and sister (ordinary notice).

Learned counsel for the petitioner submits that to his knowledge, the parties have come to amicable settlement and

Considering the aforesaid development that has taken place and informed by the learned counsel for the petitioner, this Court is inclined to extend him privilege of anticipatory bail with conditions.

Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Begusarai in connection with Complaint Case No. 89C of 2021 subject to condition as laid down under Section 438(2) of the Cr.P.C with further conditions: (i) one of the bailor should be the wife of the petitioner, namely, Rinku Devi who shall provide official document to show her bona fide.
