The petitioner apprehends his arrest in connection with Bachhwara P.S. Case No. 143 of 2015 (G.R. No. 3301 of 2015) registered under Sections 498A, 304B, 120B of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act. The allegation of complainant/informant Abhishek Kumar is that the marriage of his sister was performed on 22.05.2013 with the petitioner. Later on, she was being tortured for demand of Alto Car and due to non-fulfillment of demand, she was being given poisonous medicine on the pretext of her ill health and due to that reason, she died.

No.47298 of 2015 (3) dt.27-01-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that petitioner happens to be the husband of the deceased, Lovely Kumari, sister of the complainant/informant. The deceased was suffering from tuberculosis and she was treated in different places and subsequently, she died. The informant was also present in course of treatment and funeral ceremony, but later on after two months, the informant lodged this false complaint case No. 1203 of 2015 in the Court of C.J.M., Begusarai, which is the basis of the present case.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Begusarai in connection with Bachhwara P.S. Case No. 143 of 2015 (G.R. No. 3301 of 2015), subject to the condition as laid down under Section 438(2) of the Cr. P.C.
