ANJANA MISHRA ORAL ORDER 11-11-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 147/148/149/302 of the Indian Penal Code and Section 27 of the Arms Act.
Diary in this case was called for earlier, which has, since been received.
Learned counsel for the petitioner submits that the petitioner and one Arjun Yadav are said to have been order-giver in the present case. It is further submitted that two of the other persons who are said to have assaulted the deceased and also out of them one is said to have fired on the deceased, have been extended the privilege of anticipatory bail in connection with the present case.
Patna High Court Cr.Misc. No.27906 of 2016 (3) dt.11-11-2016 P2/2 A supplementary affidavit has been filed before this Court bringing on record the said order.
Learned counsel for the petitioner submits that the anticipatory bail petition of Arjun Yadav was disposed of with observation made in Cr. Misc. No. 26816 of 2013 and later, he was granted bail by the learned Court below.
Considering the fact that the petitioner's case stands on similar footing as of Ajay Yadav as an order-giver, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Nawada, in connection with Nadriganj P.S. Case No. 100/2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
