The petitioner seeks regular bail in Madhepura P.S. Case No. 762/2018, registered for the offences punishable under Section 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade (TIP) has been held. Name of the petitioner has come in confessional statement of co-accused as mentioned in para 22 and 23 of the case diary, which also find mentioned in the impugned order. Petitioner is in custody since 19.09.2018 having clean antecedent.
Considering the facts and circumstances of the case,
Patna High Court Cr.Misc. No.678 of 2019(2) dt.18-01-2019 2/2 prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 762/2018, subject to the condition that both the bailors will be close relative of the petitioner.
