The petitioner apprehends his arrest in connection with Dawath P.S. Case No. 74 of 2015, G.R. No. 1023 of 2015 registered under Sections 272 and 273 of the Indian Penal Code and under Section 47 of the Excise Act.
The prosecution case is that on seeing the vehicle of the Police Personnel, one person started to flee away with gunny bag. When the Police personnel tried to chase him, he ran away leaving the gunny bag and on search, 150 bottles each containing 150 ml. illegal country made wine was recovered. The neighbour disclosed the name as Amarjeet Singh.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.47286 of 2015 (2) dt.28-01-2016 2/2 petitioner submits that in fact, petitioner is authorized salesman of wine shop of registered owner of Sabita Devi, which would appear from Annexure-2 of the petition. Learned counsel for the petitioner further submits that since the petitioner, being the salesman of the wine, could not fulfill the demand of the Police, the present case has been lodged by the informant. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Bikramganj, Rohtas in connection with Dawath P.S. Case No. 74 of 2015 (G.R. No. 1023 of 2015), subject to the condition as laid down under Section 438(2) of the Cr. P.C.
