JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is apprehending her arrest in connection with Majhauliya P.S. Case No. 16 of 2017 for the offences instituted under Sections 366(A)/34 of the IPC. The prosecution story, in brief, is that the daughter of the informant, namely, Fuljahana Khaoon, aged about 16 years, went out side the house at 7 O'clock in the evening on 29.10.2016 for call of nature, during which unknown persons have kidnapped her for the purpose of marriage. The informant searched her out but she could not found and then on 15.01.2017 this F.I.R. has been lodged.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of
Patna High Court Cr.Misc. No.28395 of 2017 (2) dt.06-07-2017 2/2 tampering with the witnesses alleged against the petitioner. The petitioner is a lady. The victim girl has been examined under Section 164 Cr. P.C. where she has admitted to have love affairs with co-accused Tasmuddin.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of six weeks from today in connection with Majhauliya P.S. Case No. 16/2017 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran at Bettiah, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
