JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2015 Heard learned counsel for the petitioners, learned counsel appearing on behalf of Complainant as well as learned counsel for the State.
The petitioners, who are brothers, apprehend their arrest in a case under section 406/34 of the Indian Penal Code. The complainant Gajendra Narayan Singh alleged that he gave Rs.90,000/- to Ranjeet Kumar Singh in the year 2010 in presence of his brother Ajit Singh and father Ramanand Singh. It is alleged that inspite of repeated reminders, Ranjeet Kumar Singh did not pay back the amount.
The petitioners state that the present case which has been
Patna High Court Cr.Misc. No.48827 of 2014 (3) dt.01-07-2015 filed in the month of October, 2012 is an aftermath of the earlier case filed by the petitioners' sister Nirmala Devi against own brother of the present complainant Gajendra Narayan Singh leading rise to Complaint Case No.1498 of 2012 filed on 29.8.2012. In the aforesaid case filed by the petitioners' sister Nirmala Devi, the present complainant is also an accused. Having regard to the facts and circumstances of the case, the petitioners Ranjeet Kumar Singh and Ajeet Kumar Singh are directed to be released on anticipatory bail, in the event of their arrest/surrender, Saharsa in connection with Complaint Case No.2110C of 2012 on furnishing bail bond of Rs.5,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate,Saharsa. The trial court is directed to expedite the trial of the case.
