JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2015 Heard learned counsel for the petitioner and the State. Both these cases are taken up together as they arise from Arwal P.S. Case No.144 of 2014.
The petitioners apprehend their arrest in a case under sections 370, 370(i), 372, 373, 419, 353, 427, 224 and 1209 of the Indian Penal Code and sections 6, 8 of the Prevention of Children from Sexual Offence Act, 2012 as well as Sections 3, 4, 5, 7 and 8 of Immoral Traffic Prevention Act.
Patna High Court Cr.Misc. No.50299 of 2014 (4) dt.01-07-2015 Learned counsel for the petitioner submits that petitioner Mamta Devi is wife of petitioner Patel Ram in Criminal Misc. No.50672 of 2014. He submits that the prosecution has not mentioned the name of male counter part of female who was alleged to be in compromising position.
Having regard to the facts and circumstances of the case, the petitioner Mamta Devi is directed to be released on bail, in the event of her arrest/surrender, in connection with Arwal P.S. Case No.144 of 2014, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge, I, Jehanabad. However, the prayer for anticipatory bail of petitioner Patel Ram in Criminal Misc. No.50672 of 2014 is rejected. If he surrender and pray for regular bail, the same would be disposed of on its own merit without being prejudice by the fact that his prayer for anticipatory bail has been rejected by this court.
