ANJANA MISHRA ORAL ORDER 18-07-2016 Heard learned Senior Counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 420/406/34 of the Indian Penal Code and subsequently Section 3⁄4 of the Dowry Prohibition Act was added.
Learned Senior Counsel for the petitioners submits that the present case is one in which the marriage negotiations between the parties have failed and the informant has taken the nasty step of lodging the First Information Report making false and frivolous allegation of having taken money by way of dowry and then refusing to enter into the marriage between the informant's daughter and the son of petitioner No. 2. He further submits that
Patna High Court Cr.Misc. No.27905 of 2016 (2) dt.18-07-2016 P2/2 there were no such negotiations, rather the boy had refused to marry and, therefore, they were not willing to go further with any negotiation with the informant's side.
Considering the fact that both the petitioners are aged women and there is a cloud on the prosecution story, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Barh P.S. Case No. 86 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
