JUSTICE RAVI RANJAN ORAL ORDER 08-03-2016 I have heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest in a case registered for offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Petitioner no. 1 is father-in-law and petitioner no. 2 is mother-in-law of the deceased.
It is contended that there is general and omnibus allegation against all the family members of strangulating the deceased to death. Learned counsel has submitted that it has come during the course of investigation that there was some quarrel
Patna High Court Cr.Misc. No.47324 of 2015 (4) dt.08-03-2016 2/2 between the husband and wife and when the wife was talking to somebody on her cell-phone the same was snatched by the husband and thrown and broken and on that she committed suicide.
It is contended that husband is already in jail custody.
Having regard to the facts and circumstances of the case, let the petitioners, namely, Kamlesh Ram and Sita Devi be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Kamtaul P.S. Case No. 68/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Laheriasarai, Darbhanga subject to the conditions as laid down under subsection(2) of Section 438 of the Code of Criminal Procedure.
